Privacy Policy for the M3 EU Careers Jobs Board


Introduction

This privacy policy (Careers Privacy Policy) is for the Careers jobs board website (Careers).

There are two types of users of Careers:

Advertisers: users providing content relating to jobs to be published via Careers (Job Adverts); and

Candidates: users searching for or receiving content relating to jobs via Careers.

Careers is operated by M3 (EU) Limited (us, we or our), a company registered in England under number 3527430. Our registered office is at One Valentine Place, London SE1 8QH.

This privacy notice aims to inform you about how we process your personal data for Careers and tells you about your privacy rights under data protection laws. Careers is a separate website from the Doctors.net.uk, which is also run by us. The Careers Privacy Policy is in addition to the Doctors.net.uk privacy policy at https://www.doctors.net.uk/_datastore/privacy-policy-dnuk.

For the purposes of EU data protection laws, we are the ‘controller’ of the personal data we collect about you through and in connection with our operation of Careers. We are registered as a data controller with the UK Information Commissioner's Office. Our data protection registration number is Z5861600.

Careers incorporates privacy controls which affect how we will process your personal data. By using the privacy controls, you can specify your preferences.

1. How we use your personal data

1.1 In this Section 1 we have set out:

  • the general categories of personal data that we process;
  • in the case of personal data that we did not obtain directly from you, the source and specific categories of that data;
  • the purposes for which we may process personal data; and
  • the legal bases of the processing.

1.2 Usage data: We process data about your use of Careers. The usage data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use. The source of the usage data is Google Analytics. Where this involves the use of cookies, we will ask you to consent to our use of any cookies that are not strictly necessary for the provision of Careers. We process usage data for the purposes of analysing the use of Careers. The legal basis for this processing is our legitimate interests, namely monitoring and improving Careers.

1.3 User data: We process personal data that you provide when registering to become a Careers user. Your registration data comprises some personal data that is mandatory in order to join Careers and some personal data that is optional.

The data required in order to become an Advertiser user of Careers (mandatory user data) includes:

  • First name
  • Surname
  • Organisation
  • Email address
  • Contact number
  • VAT Registration Number if in the UK
  • Employer Type
  • Response to M3 Careers E-mail Opt-in/Opt-out

The data required in order to become a Candidate user of Careers (mandatory user data) includes:

  • First name
  • Surname
  • Citizenship
  • Country
  • Postcode
  • GMC registration number (not applicable for non-UK doctors)
  • Speciality
  • Seniority
  • Current salary
  • Email address
  • Contact number
  • Preferred role type
  • Name of current employer
  • International job seeking locations
  • Response to M3 Careers E-mail Opt-in/Opt-out

Optional data includes:

  • Sub-speciality
  • Desired salary
  • Medical school and graduation year
  • Professional title
  • Short Biography
  • Social Preferences
  • City

When responding to a Job Advert the following is mandatory:

  • CV

We will use this data for the purposes of registering you as a user of Careers, authenticating your access to Careers, identifying you as the registered user, controlling and enabling you to access areas of Careers that are restricted to users (depending on whether they are Advertisers or Candidates) and enabling you to reset your password and gain access to Careers if you forget your username or password. The legal basis for this processing is our legitimate interests, namely ensuring the security of our network, IT systems and information and providing users of Careers with a means of accessing Careers. If you are a Candidate User we may also send you Job Adverts which may be of interest to you. The legal basis for this processing is the performance of our contract with you under the Careers Terms and Conditions.

1.4 Use of your user data for career survey purposes: If you have indicated that you want to receive e-mails invitations to participate in career surveys, we will use your mandatory user data for the purposes of:

  • inviting you to take part in career surveys related to your career
  • monitoring and enabling your participation in career survey activities via Careers, to ensure that any incentives offered for taking part in such activities are correctly credited to you

This use of your data involves an element of profiling and automated decision making, in that we may screen our users (using automated means) to ensure we send specific career survey activities to qualifying participants.

The legal basis for this processing is our legitimate interests, namely obtaining information about the career market to support the delivery of our product offerings. Where incentives are offered in return for taking part, the legal basis for our processing of your user data for the purposes of crediting you with those incentives will be performance of a contract.

1.5 Use of your user data for marketing and communications purposes: We will use your mandatory user data to send the following marketing and communications to your email address:

  • Jobs Alerts: we will only send you Job Alerts if you have indicated that you want to receive them.
  • Occasional Careers e-mails and survey invitations: we will only send such emails to you if you have indicated that you want to receive them. These emails will relate primarily to Careers related matters or to survey participation.
  • Other communications that we may add from time to time and notify you of via your registration, giving you the opportunity to opt-in or opt-out.

You can opt-out from any marketing specific communications by using the unsubscribe facility in the communication itself. This will also automatically update your preferences within Careers. We may also prompt you from time to time to revisit and update your communication preferences with the aim of ensuring that we only send you relevant and wanted communications.

The legal basis for this processing is legitimate interests, namely:

  • our interests in providing marketing, advertising, communications and recruitment-related services to our users, providing relevant information to our users and operating our business and Careers
  • our Advertiser’s interests in promoting and advertising their Job Adverts or recruiting suitable candidates for jobs with them.

1.6 Using your user data for our own marketing purposes: We will use your email address and/or phone numbers in order to let you know about our range of products and services for our own internal marketing purposes. This may, for example, include communications about our products and services if you have not visited Careers recently. The legal basis for this processing is our legitimate interests, namely to communicate our range of products and services, and improvements to them, to our users.

1.7 Data collected as a result of your participation in career survey activities: If you take part in any career survey activities, we will process some of your user data as necessary to enable you to participate in the survey. We do not disclose your user data with anyone else unless you have opted in to permit such sharing as part of a survey.

We do not disclose any personal data from Career surveys to any third party. Any information shared is aggregated and non-identifiable.

1.8 Enquiry data: We will process information contained in or relating to any communication you send to or have with us, such as when you complete a form requesting more information, a call-back or newsletter communications from a range of organisations who use Careers to share promotional and/or educational content relating to their products and services. The correspondence data provided via email or telephone calls may be processed for the purposes of communicating with you, logging your communication, and for the management of your registration. We will process your enquiry data for the purposes of responding to your enquiry, and if you request to be contacted directly by a relevant third party organisation, we will pass the contact details you used to make your enquiry to the relevant third-party organisation for this purpose. The legal basis for this processing is our legitimate interests in communicating with our users and Advertisers’ and Candidates’ legitimate interests in communicating with each other as well as the proper administration of Careers and our business and communications with users

1.9 Transaction data: We may process information relating to transactions, including purchases of services that you enter into with us and/or through Careers. The transaction data may include your email address, name, and the transaction details. The transaction data may be processed for the purpose of supplying the purchased goods and services, the legal basis for this being the performance of a contract between you and us. We will also keep records of those transactions, the legal basis for this being our legitimate interests in the proper administration of our business.

1.10 Using your personal data for other purposes: In addition to the specific purposes for which we may process your personal data set out in this Section 1, we may also process any of your personal data where such processing is necessary for:

  • compliance with a legal obligation to which we are subject
  • protecting your vital interests or the vital interests of another natural person
  • obtaining or maintaining insurance coverage, managing risks, or obtaining professional advice. (The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks)
  • the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. (The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.)

1.1 Other peoples’ personal data: Please do not supply any other person’s personal data to us, unless you have such person’s consent.

2. Providing your personal data to others

2.1 We may disclose your personal data to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes set out in this policy.

2.2 We may disclose your profile data to our suppliers or subcontractors insofar as reasonably necessary in order to deliver Careers. Such third party suppliers or subcontractors may use your profile data to support the activities described in clause 1 above. We may also give third party suppliers or subcontractors direct access to Careers which will enable them to access your profile and usage data to support the delivery of Careers. Your personal information will only be shared with such third parties where sharing the information is consistent with your communication preferences and no personal data will be shared or processed for any other reason than what it was collected for.

2.3 Financial transactions relating to Careers may be handled by our payment service provider PayPal. We will share transaction data with our payment service provider only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. 2.4 Where you consent, we may disclose your enquiry data to one or more of those selected third-party organisations identified on Careers, for the purposes of the third-party organisations offering relevant products and/or services to you.

Categories of these third-party organisations are as follows

  • Advertisers
  • Recruiters
  • Companies and participants in the healthcare industry
  • Financial services companies

Each such third party will act as a data controller in relation to the enquiry data that we supply to it; and such third party’s own privacy policy will govern that third party's use of your personal data.

3. International transfers of your personal data

3.1 In this Section 3, we provide information about the circumstances in which your personal data may be transferred to countries outside the European Economic Area (EEA).

3.2 We and our other group companies have offices and facilities in China, India, Japan, South Korea, Latin America, and the United States. Transfers to each of these countries will be protected by appropriate safeguards, namely the use of standard data protection clauses adopted or approved by the European Commission. 3.3 The hosting facilities for our general M3 EU website are situated in the EEA. The saas platform which runs Careers is jobsboard.io and the hosting facilities are situated in the United States.

4. Retaining and deleting personal data

4.1 This Section 4 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

4.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

4.3 We will retain and delete your personal data as follows:

  • Your user and transaction data will be retained for five years from the date on which your registration has become inactive. After this period, this data will be deleted from our systems.
  • Your usage data and market research data are anonymised and will be retained for as long as it is required.
  • Your correspondence data, which is a record of our communications with you together with any communications you have sent us, will be retained for as long as necessary to fulfil the purpose for which we collect the data. This data will include your first name, last name and e-mail address, all other personal data will be anonymised.

4.4 Notwithstanding the other provisions of this Section 4, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

5. Security of personal data

5.1 We will take appropriate technical and organisational precautions to secure your personal data and to prevent the loss, misuse or alteration of your personal data.

5.2 We will store all your personal data on secure servers, personal computers and mobile devices.

5.3 Data relating to your enquiries and financial transactions that is sent from your web browser to our web server, or from our web server to your web browser, will be protected using encryption technology.

5.4 You acknowledge that the transmission of unencrypted (or inadequately encrypted) data over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet. GMC and BMA guidance states that doctors should not send any patient identifiable data across the internet. You should not post patient identifiable information on Careers.

5.5 You should ensure that your password is not susceptible to being guessed, whether by a person or a computer program. You are responsible for keeping the password you use for accessing Careers confidential and your password will only be used when you log in to Careers. We will never ask you for your password.

6. Amendments

6.1 We may update this policy from time to time by publishing a new version on Careers.

6.2 We may notify you of changes to this policy by email or through Careers.

7. Your rights

7.1 In this Section 7, we have summarised the rights that you have under data protection law. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights.

7.2 Your principal rights under data protection law are:

(a) the right to access;

(b) the right to rectification;

(c) the right to erasure;

(d) the right to restrict processing;

(e) the right to object to processing;

(f) the right to data portability;

(g) rights related to automated decision-making including profiling;

(h) the right to complain to a supervisory authority; and

(i) the right to withdraw consent.

7.3 You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data, after you supplied appropriate evidence of your identity (this will require you to log in). The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee.

7.4 You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed. You have the ability to update and complete your user data yourself on the Profiles page.

7.5 In some circumstances, you have the right to the erasure of your personal data without undue delay and which we will endeavour to do within one calendar month of your request. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are certain general exclusions of the right to erasure. Those general exclusions include where processing is necessary for exercising the right of freedom of expression and information and for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

7.6 In some circumstances, you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

7.7 You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims. If you object specifically to the processing of your user data, then fulfilment of this request will require the termination of your user registration at Careers.

7.8 You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, we will cease to process your personal data for this purpose.

7.9 If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

7.10 To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

7.11 You may exercise any of your rights in relation to your personal data by contacting our Member Services team by email [email protected].

8. Third party websites

8.1 Careers includes hyperlinks to, and details of, third party websites.

8.2 We have no control over, and are not responsible for, the privacy policies and practices of third parties.

9. Personal data of children

9.1 Careers is targeted at persons over the age of 18.

9.2 If we have reason to believe that we hold personal data of a person under that age in our databases, we will delete that personal data.

10. Updating information

Please let us know if the personal information that we hold about you needs to be corrected or updated. You can also update this on the Profiles page of Careers.

11. Cookies

11.1 A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.

11.2 Cookies may be either persistent cookies or session cookies: a persistent cookie will be stored by a web browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed.

11.3 Cookies do not typically contain any information that personally identifies a user, but personal information that we store about you may be linked to the information stored in and obtained from cookies.

12. Tracking Technologies

12.1 Careers is hosted by jobboard.io and uses cookies or similar technologies to analyse trends, administer the Website, track users’ movements around the website, and to gather demographic information about our users. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our website. Our services do not respond to Do Not Track (DNT) signals on your browser.

13. Consent

Depending on the applicable laws in the country from where you access Careers, in most cases we will need your consent in order to use cookies on Careers. The exception is where the cookie is essential in order for us to provide you with a service you have requested.

14. Turning off or controlling Cookies

14.1 Please note that certain areas of Careers can only be accessed by having cookies enabled and you should be aware that disabling or blocking all cookies may prevent you from accessing some of our content and accessing all the features of our services.
